Subject: Designation of Regional Centers Under the Immigrant Investor Pilot Program

The Immigrant Investor Pilot Program modifies the job creation requirements of the immigrant investor visa by allowing an investor to demonstrate that his or her investment is within a regional center approved pursuant to 8 CFR 204.6(m)(3) and (4) and that such investment will create full-time jobs for not fewer than 10 persons either directly or indirectly through revenues generated from increased exports resulting from the new commercial enterprise. The Office of Adjudications has recently designated several new regional centers, which are attached. The following is a list of all designated regional centers as of August 18, 1997:

When a service center adjudicates a Form I-526 petition for an immigrant investor under the Pilot Program, the petitioner must attach a copy of the appropriate regional center designation by the Assistant Commissioner for Adjudications. The new commercial enterprise must be located within the area specified in the regional center designation letter and the investment must otherwise meet the requirement of 8 CFR 204.6 (m)(7)(I) and (ii).
