AILA Sends Letter to DHS and DOS Urging EB-4 Administrative Action

On December 6, 2023, DOS responded to AILA’s letter urging EB-4 administrative action. The letter notes that DOS understands the concerns surrounding the change in interpretation but that they are unaware of any authority that would have permitted a transition period.


On October 19, 2023, DHS responded to AILA’s letter. The letter notes that USCIS is considering a variety of policy and regulatory options, including those proposed by AILA, to reduce the challenges faced by those waiting for EB-4 visas.


AILA sent a letter to DOS and DHS urging immediate administrative action to remedy the harms experienced by religious workers, diplomats, SIJS youth, and other EB-4 applicants when the DOS changed its interpretation of how it allocates EB-4 immigrant visas.
