OMB Movement on I-140 EAD Proposed Rule

The Office of Information and Regulatory Affairs (OIRA) of the Office of Management and Budget (OMB) has posted notice that OMB concluded Executive Order 12866 regulatory review of a proposed regulation titled, "Retention of EB-1, EB-2, and EB-3 Immigrant Workers and Program Improvements Affecting Highly-Skilled H-1B Alien Workers" on December 22, 2015. Clearance of a regulation by OMB is a necessary step in the regulatory process.

The proposed I-765 revisions are to accommodate an EAD for beneficiaries of approved I-140 petitions.

AILA will post proposed revisions to the Form I-765 to AILA.org once they are published in the Federal Register.

DHS published a proposed rule to amend its regulations related to EB-1, EB-2, and EB-3 immigrant and non-immigrant visa programs on December 31, 2015 (AILA Doc No. 15123001).
