P.L. 115-232: John S. McCain National Defense Authorization Act for Fiscal Year 2019

On 8/13/18, President Trump signed into law the John S. McCain National Defense Authorization Act for Fiscal Year 2019. The bill has some immigration-related provisions, including implications for certain H-2B workers on Guam and in the Commonwealth of the Northern Mariana Islands.

Highlights:

  • Section 1045 allows certain H-2B workers on Guam and in the Commonwealth of the Northern Mariana Islands (CNMI) to qualify for an exemption to the “temporary need” requirement if they begin employment on or before December 31, 2023. Section 1045 also eliminates the annual cap of 4,000 H-2B workers for Guam and the CNMI that were permitted to use the temporary need exemption.
  • Section 1222 extends and modifies the reporting requirements for Special Immigrant Visas under the Afghan Allies Protection Act of 2009.
  • Section 1291 provides for relief from inadmissibility under INA §212(a)(3)(B) with respect to activity undertaken in association with the Rwandan Patriotic Front or the Rwandan Patriotic Army before August 1, 1994, with some exceptions.
