Rep. King Introduces the Birthright Citizenship Act
On 01/05/11, Rep. King (R-IA) introduced the Birthright Citizenship Act (H.R. 140). AILA opposes this bill.
The bill would amend INA section 301 with a definition limiting which groups of individuals should be considered "subject to the jurisdiction" of the United States for the purposes of the 14th amendment, and therefore be considered nationals and citizens upon their birth in the United States.
Under the bill, birthright citizenship would be limited to individuals born in the United States who have at least one parent who is:
(1) a citizen or national of the United States;
(2) an alien lawfully admitted for permanent residence in the United States whose residence is in the United States; or
(3) an alien performing active service in the armed forces.
