Dear Stakeholder-

USCIS has the following updates to share:

1) AAO Request for Amicus Curiae Briefs Update

Previously, USCIS announced a new initiative to seek stakeholder input on specific legal issues through the submission of amicus curiae briefs. The AAO is seeking amicus briefs related to the appeal of a denied Form I-140, Immigrant Petition For Alien Worker.

In response to stakeholder requests, USCIS has posted the underlying Service Center decision.

Please note:

USCIS is posting the underlying decision for purposes of visibility and general background information only. It is not seeking comments related to the specific facts of the posted decision. Commenters are reminded that submitted briefs should focus on the question presented in the amicus brief request regarding "the nature of the 'final merits determination' and how the AAO should apply this analysis to extraordinary ability visa petitions filed pursuant to section 203(b)(1)(A) of the Immigration and Nationality Act, 8 U.S.C. § 1153(b)(1)(A)." Again, the question to be briefed is how the final merits decision should be applied to all cases, not the specific decision posted here. Since this request focuses on a final merits determination, collateral issues raised in an amicus brief and unrelated to the request will not be addressed at this time.

To give stakeholders time to review the decision, USCIS is extending the deadline to submit briefs to October 18, 2011.
