USCIS Adjustment of Status Filing Dates for April 2024

Practice Alert: Discrepancy Concerning April 2024 Visa Bulletin Final Action Date for EB-2 India

On March 4, 2024, DOS published the April 2024 Visa Bulletin. The PDF version of the Visa Bulletin listed the Final Action Date for EB-2 India as April 15, 2012. However, the web-based version of that Visa Bulletin listed the date as April 1, 2012. Similarly, the USCIS Adjustment of Status Filing Chart used the April 1, 2012, date for EB-2 India.

After being alerted about the discrepancy by members, AILA contacted DOS to confirm the correct date. On March 9, DOS confirmed that the EB-2 Final Action Date for India should be listed as April 15, 2012, and updated the web-based version of the Visa Bulletin. AILA has also contacted USCIS to notify them of the discrepancy and the updated date on the DOS website and asked them to update the AOS Filing Chart. USCIS acknowledged our request and updated its website on Monday, March 11, 2024.

For Family-Sponsored Filings:
For all family-sponsored preference categories, you must use the Dates for Filing chart in the Department of State Visa Bulletin for April 2024.

For Employment-Based Preference Filings:
For all employment-based preference categories, you must use the Final Action Dates chart in the Department of State Visa Bulletin for April 2024.
