Combined EAD and Advance Parole Cards Issued In Error (Updated 7/24/08)

7/24/08 AILA Doc. No. 08071880.

On Friday, July 18, 2008, AILA liaison reported that USCIS had erroneously issued some number of EAD documents to adjustment of status applicants under 8 C.F.R. § 274a.12(c)(9) with the notion "Serves as I-512 Advance Parole." USCIS has advised AILA that they have identified approximately 30 EAD cards where this error occurred, all issued from the Texas Service Center. It appears that all of the erroneously-issued cards had two-year employment authorization. USCIS informed AILA that it will be contacting those applicants/attorneys to explain the error and provide instructions on how to obtain a corrected card.

If your clients were issued a two-year EAD card from TSC, please double check to make sure that it does not have this incorrect I-512 notation.

USCIS Service Center Operations has informed AILA liaison that recently-issued EADs with a notation "Serves as I-512 Advance Parole" have been issued in error. The employment authorization is valid, but, the advance parole notation is not valid. If an alien requires an I-512 Advance Parole document for international travel, the alien should not travel without an approved I-512 Advance Parole. USCIS has asked AILA to provide examples so that USCIS can correct the problem. If you have a client who has received an EAD with the advance parole notation, please send the alien name and the receipt number to reports@aila.org, subject: "EAD and Parole Card." USCIS will provide instructions on obtaining replacement EADs as soon as possible.
