USCIS Addresses Petitions/Applications for Transsexuals
A 4/16/04 memo from William Yates, USCIS Associate Director for Operations, instructing the field not to recognize marriages in which a party is transsexual. If the gender of the person is not pertinent to the benefit, transsexuality is not to be taken into account.
