USCIS Provides Information for Requesting I-765 Refunds for Ukrainian Parolees
USCIS provides instructions and a form for requesting a refund for Form I-765 filing fees for Ukrainian parolees.
From USCIS:
USCIS will refund the filing fee you paid for your initial Form I-765, Application for Employment Authorization, if you:
- Were paroled under the Uniting for Ukraine process or a Ukrainian paroled between February 24, 2022, and September 30, 2023;
- Filed your initial Form I-765 between May 21, 2022 and Nov. 21, 2022, based on your parole; and
- Paid a filing fee of $410.
This only applies to Uniting for Ukraine and other Ukrainian parolees who meet the criteria above. To verify your information to obtain your refund, please complete and submit the below web form.
IMMpact Litigation, seeking redress for over 100,000 Ukrainian nationals paroled into the United States post-February 2022, announced a significant advancement in their ongoing class action lawsuit against USCIS. IMMpact sued USCIS in August 2022 for failing to carry out provisions in the 2022 Ukraine supplemental which mandated Ukrainian parolees be provided automatic, free employment authorization. As a result of the litigation, USCIS changed its policy to recognize automatic work authorization in November 2022, but failed to refund unlawfully collected I-765 employment authorization document fees for applications received prior to that date. IMMpact filed a second suit in 2023 to recover those funds for 10s of 1000s of Ukrainians. USCIS announced on April 24 that it is refunding all of the I-765 fees collected from Ukrainian parolees who entered as parolees after February 24, 2022.
