DHS Announces Weighted Selection Process for Cap-Subject H-1B Petitions

DHS announced a final rule implementing a weighted selection process for cap-subject H-1B petitions that prioritizes higher-paid individuals, effective 2/27/26. It will be in place for the FY27 H-1B cap registration season. An advance copy of the rule, which will be published in the Federal Register on 12/29/25, is available.
