DHS Announces Weighted Selection Process for Cap-Subject H-1B Petitions

DHS announced a final rule implementing a weighted selection process for cap-subject H-1B petitions that prioritizes higher-paid individuals, effective 2/27/26. It will be in place for the FY27 H-1B cap registration season. The rule was subsequently published at 90 FR 60864 on 12/29/25.
