DHS and DOL Temporary Rule on H-2B Cap Increase
Joint DHS and DOL temporary rule increasing the H-2B cap for the remainder of FY2017 by an additional 15,000 visas. The rule is effective from 7/19/17 through 9/30/17, with the exception of document retention provisions effective through 9/30/20. Employers will be required to complete new Form ETA-9142-B-CAA, Attestation for Employers Seeking to Employ H-2B Nonimmigrant Workers Under Section 543 of the Consolidated Appropriations Act, certifying that their business is likely to suffer irreparable harm if unable to employ the requested H-2B workers.
