Practice Alert: Clarification Requested Concerning January 2024 Visa Bulletin EB-2 Dates for Filing Chart

DOS responded to the DOS Liaison Committee to thank AILA for raising this issue. Shortly thereafter, it appears the Department of State website was updated to adjust the EB-2 China date in the Dates for Filing chart to June 1, 2020, the same date included on the January 2024 visa bulletin PDF.

AILA also escalated this issue to USCIS. It appears that the chart embedded on the UCSIS website has also been updated to include the June 1, 2020, date included on the DOS website and visa bulletin PDF.


On the PDF version of the January 2024 Visa Bulletin, the EB-2 China priority date listed on the Dates for Filing chart is shown as June 1, 2020; however, the information on the January 2024 Visa Bulletin on the Department of State’s website lists January 1, 2020, as the date for the EB-2 China category. The USCIS “Adjustment of Status Filing Charts from the Visa Bulletin” page links to the Department of State page, and not the PDF.

Members have raised concerns and confusion surrounding this apparent mistake. AILA’s DOS Liaison Committee has noted these concerns and raised a question with the Department of State in order to obtain clarification. AILA will update this alert once that clarification has been provided.
