Practice Alert: New Edition of Form I-192 and Extension of Grace Period for Previous Edition of Form I-918

AILA's VAWA, Us and Ts Committee provides the following alert:

In April 2019, USCIS released a new edition of Form I-192, Application for Advance Permission to Enter as a Nonimmigrant. The new edition is dated April 9, 2019. AILA reminds practitioners that starting Friday, June 28, 2019, USCIS will only accept the April 9, 2019 edition of Form I-192. Until then, the December 23, 2016, edition of Form I-192 can be used.

Form I-192 can be used to apply for advance permission to temporarily enter the United States if an applicant is an inadmissible foreign national in one of the following categories:

  • Inadmissible nonimmigrant already in possession of appropriate documents;
  • Applicant for principal or derivative T nonimmigrant status; or
  • Applicant for principal or derivative U nonimmigrant status.

Please also note that USCIS recently announced that it is extending the grace period for the previous edition of Form I-918, Petition for U Nonimmigrant Status, including Supplement B, U Nonimmigrant Status Certification, through December 31, 2019. Starting January 1, 2020, USCIS will only accept the April 24, 2019 edition of Form I-918. Until then, applicants can use the February 7, 2017 edition of the Form I-918. The announcement by USCIS extending the grace period for Form I-918 came subsequent to a letter that ASISTA and AILA sent to USCIS in May 2019, requesting an extension of the grace period for the new edition of Form I-918.
