Earlier today President Trump issued a proclamation effective immediately that
0:00:10.000–0:00:14.570
bars from seeking asylum any individuals who enter the United States from Mexico
0:00:14.570–0:00:20.070
between ports of entry. Those individuals may still seek relief in the form of
0:00:20.070–0:00:23.580
withholding of removal, or protection under the Convention Against Torture.
0:00:23.580–0:00:28.050
However, these forms of protection are not only weaker than asylum they're
0:00:28.050–0:00:32.430
appreciably more difficult to qualify for. The proclamation will remain
0:00:32.430–0:00:38.250
effective for 90 days or until the establishment of a so-called safe third
0:00:38.250–0:00:43.530
country agreement with Mexico, whichever occurs earlier. By the 90th day the
0:00:43.530–0:00:48.000
secretaries of Homeland Security and State, along with the Attorney General,
0:00:48.000–0:00:53.520
must recommend to the president whether to renew or extend the proclamation.

This proclamation guts key due process protections for asylum seekers under
0:01:03.600–0:01:08.010
unambiguous laws passed by Congress. Individuals arriving to the United
0:01:08.010–0:01:13.470
States whether at or between ports of entry have the right to seek asylum.
0:01:13.470–0:01:17.790
Not everyone is eligible for that relief but everyone deserves a full and fair
0:01:17.790–0:01:22.580
opportunity to pursue it. The proclamation is a transparent end run
0:01:22.580–0:01:27.280
around these laws and has already come under legal challenge.
0:01:27.280–0:01:33.420
Unfortunately, this action is just the latest step in the administration's ongoing, systematic
0:01:33.420–0:01:38.400
effort to shut out asylum seekers from our country. In fact, it's critical to
0:01:38.400–0:01:43.079
note that in recent years Customs and Border Protection has, on an alarming
0:01:43.079–0:01:47.640
scale, illegally turned away asylum seekers who lawfully present themselves
0:01:47.640–0:01:52.480
at ports of entries. That practice in combination with today's proclamation
0:01:52.480–0:01:58.680
will force many vulnerable asylum seekers who reach the US border into a Catch 22
0:01:58.680–0:02:02.420
If they present themselves at a port of entry, CBP could turn them back.
0:02:02.420–0:02:07.350
Yet if they enter between ports of entry, under the proclamation, they'll be
0:02:07.350–0:02:12.420
stripped of the right to seek asylum altogether. Many persecuted women,
0:02:12.420–0:02:16.710
children, and family may now have no meaningful chance to
0:02:16.710–0:02:21.560
apply for asylum as guaranteed them under the law.
0:02:21.560–0:02:28.800
As such, today's proclamation puts lives at risk. Meanwhile, those who do get processed by CBP
0:02:28.800–0:02:33.640
could be thrust into a dramatically expanded ICE detention operation.

0:02:38.080–0:02:42.870
Though the administration has portrayed the caravan traveling through Mexico as somehow
0:02:42.870–0:02:47.910
evidence of a U.S. border in peril, nothing could be further from the truth.
0:02:47.910–0:02:53.820
Border apprehensions in fiscal year 2018 were markedly low compared to prior
0:02:53.820–0:02:58.800
decades. And a caravan that remains hundreds of miles away that consists of
0:02:58.800–0:03:04.380
hungry tired Central Americans fleeing violence and hardship in no way poses a
0:03:04.380–0:03:10.020
threat to the most powerful nation on earth. Let's be clear then, there is no
0:03:10.020–0:03:14.940
border crisis. There is, however, a humanitarian crisis in Central America,
0:03:14.940–0:03:20.580
where rampant gang violence, domestic abuse, and other dangers have prompted
0:03:20.580–0:03:25.620
continuing outflows of asylum seeking families and children. Our government
0:03:25.620–0:03:30.640
must step up and address this humanitarian emergency.
0:03:30.640–0:03:36.800

0:03:36.800–0:03:41.360
To begin with, the Administration should uphold its legal obligation under
0:03:41.400–0:03:46.850
domestic and international law to ensure individuals right to seek asylum. Where
0:03:46.850–0:03:51.410
the Administration fails to do so, Congress must hold it fully accountable.
0:03:51.410–0:03:56.660
In addition, the administration should build up refugee processing programs in
0:03:56.660–0:04:01.580
the region, not tear them down. In the absence of such processing options many
0:04:01.580–0:04:05.990
persecuted individuals may feel they have no choice but to make dangerous
0:04:05.990–0:04:11.300
treks north in pursuit of asylum. The administration must also get more
0:04:11.300–0:04:15.560
serious about providing foreign assistance to allay the human rights
0:04:15.560–0:04:20.750
abuses driving Central American displacement. In all, there are a host of
0:04:20.750–0:04:24.860
meaningful ways in which our government can and should respond.
0:04:24.860–0:04:29.620
Today's proclamation is not one of them.
