USCIS Policy Alert Revising Age Calculation Under the Child Status Protection Act

USCIS updated the Policy Manual to clarify when an immigrant visa becomes available for calculating Child Status Protection Act (CSPA) age in certain situations. For any requests filed on or after 8/15/25, USCIS will return to using the DOS Visa Bulletin’s Final Action Dates chart, rather than the Dates for Filing chart, to determine a derivative beneficiary’s age for adjustment of status purposes.
