DOS Names Posts for IV Fee Pre-Payment
DOS names the ten posts where a new rule requiring applicants to pay the processing fee prior to formal application will be implemented. (65 FR 54598, 9/8/00)
DOS Will Phase-In IV Fee Pre-Payment
DOS proposes to initially implement at only ten posts a requirement that immigrant visa applicants pay the processing fee prior to formal application. Other posts would be added later. Comments are due by 11/7/00. (65 FR 54412, 9/8/00)
DOS Imposes Fee on Form I-864
DOS final rule announcing that a $50 fee will be imposed on all I-864 Affidavits of Support sent to petitioners by the NVC or overseas posts after 10/1/00. The fee does not apply to I-864s filed with INS. (65 FR 54148, 9/7/00)
INS Interim Regulation on National Interest Waivers for Physicians

INS Notice of the Termination of TPS for Bosnia-Herzegovina

DOS Interim Rule Waiving Visa Fees for B-1 UN Observers

DOS Interim Rule Adding DOL for Approval of H-2As
DOL interim rule authorizing consuls to accept petitions from the Department of Labor for the issuance of H-2A visas, in accordance with regulation changes previously published by DOL and INS. (65 FR 52305, 8/29/00)
DOL Notice of Intent to Revise Labor Certification Program
DOL announces that it is developing plans to change the permanent labor certification program to a system of pre-filing recruitment (similar to RIR), automated review (similar to LCA faxback), and targetted and random audits of applications. (65 FR 51777, 8/25/00)
DOL Issues H-1C Nurses Regulation

DOL Conversion Regulations for Labor Certification Process

INS Proposed Rule to Create Uniform Procedure for AEDPA
INS proposed rule to apply Antiterrrorism and Effective Death Penalty Act of 1996 (AEDPA) section 440(d)'s elimination of 212(c) relief for certain individuals only to those whose proceedings were commenced after AEDPA's enactment on 4/24/96. (65 FR 44476, 7/18/00)
INS Interim Regulations on Family Unity
INS interim regulation amendments to conform to the Hernandez v. Reno settlement with provision for requesting employment authorization on the Form I-817 and clarification that beneficiaries remain eligible if the principal naturalizes. (65 FR 43677, 7/14/00)
INS Proposes Changes to H-2A Form and Fee Collection
INS proposes that a new form be used for filing H-2A requests with DOL, and includes a requirement that beneficiaries sign petitions requesting extension or change of status to H-2A. Comments due 8/14/00. (65 FR 43535, 7/13/00)
INS Transfers H-2A Authority to DOL
INS final rule, effective 11/13/00, providing that H-2A petitions be filed with the Labor Department on a combined petition/certification form. DOL will forward to INS for adjudication requests for extensions of H-2A status or for change of status to H-2A. (65 FR 43527, 7/13/00)
DOL Proposes New Fee Structure for H-2A Petitions
DOL proposes a 3-tier fee for H-2A certifications, based on the number of workers sought and ranging from $150 to $1,000 per certification. The standard I-129 filing fee also would apply. Fees would be refunded if the petition is denied. Comments are due by 8/14/00. (65 FR 43545, 7/13/00)
DOL Takes on H-2A Authority
Under a DOL regulation effective 11/13/00, DOL will have the authority to adjudicate and revoke H-2A petitions, which are to be filed on a single form that consolidates the I-129 and ETA 750 for these purposes. (65 FR 43538, 7/13/00)
INS to Accept Untimely MTRs on EB-2 Cases
In accordance with the Chintakuntla v. INS court order, INS announces that untimely motions to reconsider can be filed by 11/1/00 for EB-2 equivalency cases with administratively final denials issued between 7/1/97 and 3/20/00. (65 FR 41093, 7/3/00)
INS Proposed Regulation on Indefinite Detention
INS proposed rule for review process governing detention of persons ordered removed but whose removal has not been effected within 90 days. Comments are due by 7/31/00. (65 FR 40540, 6/30/00)
EOIR Final Rule on Attorney Discipline Rules
EOIR final rule that also addresses practice before the INS, provides for investigation of complaints and sanctions against attorneys, and makes the BIA the reviewing body for decisions relating to infractions before the EOIR. The rule does not extend to government attorneys. (65 FR 39513, 6/27/00)
Asylum Jurisdiction for Hawaii and Guam Changed
INS final rule transferring jurisdiction over Hawaii and Guam asylum cases to the Los Angeles asylum office from San Francisco, effective 7/24/00. (65 FR 39071, 6/23/00)
INS Notice of Extension of TPS Re-Registration for Honduras
INS notice that TPS for Honduras is effective 7/6/00, and will remain in effect until 7/5/01. The re-registration period began 5/11/00 and will remain in effect until 7/5/00. EADs under the initial Honduras TPS designation are automatically extended until 12/5/00. (65 FR 36719, 6/9/00)
