HHS Updates Poverty Guidelines for 2005
HHS has updated its poverty guidelines for 2005 to account for last year's increase in prices as measured by the Consumer Price Index. These data are used in determining ability to provide support in connection with the affidavit of support. (70 FR 8373, 2/18/05)
DOS Publishes Final Rule Amending SEVIS Regulations
DOS final rule, effective 5/23/03, adding the requirement that consular officers verify SEVIS-generated I-20s and DS-2019s in the Consolidated Consular Database, and verify the payment of SEVIS fees. The rule also makes Border Commuter Students subject to SEVIS requirements. (70 FR 7853, 2/16/05)
DOL Notice on Mailing Non-Electronic PERM Filings on or after 3/28/05
DOL notice with mailing addresses and designated Processing Center for PERM applications filed by mail, rather than electronically, on or after the 3/28/05 PERM effective date. "Applications submitted by mail will not be processed as quickly as those filed electronically." (70 FR 6734, 2/8/05)
DOS Final Rule with Schedule of Fees for Consular Services
Effective 3/8/05, the Department of State's final rule contains four changes, including the already effective additional exemption to the MRV fee, and three new fees. (70 FR 5372, 2/2/05)
EOIR Interim Rule on Background and Security Investigations
EOIR's interim rule makes significant changes affecting granting of relief in removal proceedings pending security investigations, and consequences of respondents’ failure to comply. Comments are due 4/1/05. (70 FR 4743, 1/31/05)
DOL Proposed Regulations with Major Changes to the H-2B Process
The DOL and DHS concurrently published rules substantially changing the H-2B petition process to make it a “one-step.” The proposed rules require electronic filing and eliminate the labor certification application requirement. Comments are due on or before 2/28/05. (70 FR 3993, 1/27/05)
DHS Publishes Proposed Regulations with Major Changes to the H-2B Process
DHS and DOL concurrently published rules changing the H-2B petition process to make it a “one-step.” The proposed rules require electronic filing and eliminate the labor cert. application requirement. DOL will retain audit authority and responsibility. (70 FR 3983, 1/27/05)
Extension of TPS for El Salvador
The 60 day re-registration period begins 1/7/05 and ends 3/8/05. The DHS notice provides instructions for re-registration, including the new filing process with designated USCIS Lockbox addresses or e-filing. Only the 11/5/04 revised form I-821 accepted. (70 FR 1450, 1/7/05)
DOL Notice of Staff Relocation of Foregn Labor Certification Field Staff
DOL notice that all foreign labor certification processing previously conducted in the Atlanta and Chicago Regional Offices will now be assumed by the corresponding Atlanta or Chicago National Processing Centers. Specific instructions are provided for H-2A and H-2B filings. (70 FR 1473, 1/7/05)
ICE/EOIR Final Rule on Countries to Which Foreign Nationals May Be Removed
Joint ICE/EOIR final rule providing new procedures for designation and determination of a country for removal, acceptance by a country is not required, and the determination of a "country" does not require the existence or functionality of a government. (70 FR 661, 1/5/05)
DOS Publishes Notice of Implementation of the Biometric Visa Program
Commenced as a pilot program in September 2003, the Biometric Visa Program became a permanent program effective 10/26/04. The notice outlines the program's use of two index fingerscans and a photograph, its coordination with US-VISIT, and exemptions from the program. (69 FR 78515, 12/30/04)
USCIS Publishes Correction Notice with Exemptions to Direct Filing
USCIS notice correcting its 11/19/04 notice by providing three exemptions to the direct filing rule: I-485’s for 101(a)(27)(I) special immigrants; and I-765’s for certain deferred action cases, including specified I-360, T and U cases. (69 FR 77768, 12/28/04)
DOL Publishes PERM Regulation
DOL publishes final regulations implementing the PERM permanent labor certification program. Significant changes are made from the proposed rule. The new Form 9089 is at the end of the pdf version of the regulation, found under PDF Resources in this document. (69 FR 77325, 12/27/04)
DHS Expands Basic Pilot Program Nationwide
USCIS notice that the Basic Pilot Program, which allows employers to get automated confirmation of employment authorization, has been expanded to all 50 states and D.C. Also announced is USCIS's web-based access to employers volunteering to participate in the program. (69 FR 75997, 12/20/04)
DOL Proposed Rule on Service Contract Act Wage Determination Online Request Process
DOL proposed rule to amend regulations to allow full implementation of the Wage Determination Online Internet website, reflect changes in a title and various statutory citations, as well as update a list of Wage and Hour Division Regional Offices. DHS Notice of Additional Privacy Act Systems of Records

DOS Designates Jam'at Tawhid al wa'al-Jihad, et al, a Foreign Terrorist Organization
Effective 12/6/04, the DOS designates Jam'at Tawhid al wa'al-Jihad, and all aliases, translations and transliterations of that name listed, a Foreign Terrorist Organization, and determines that no prior notice need be provided to any person subject to the determination. (69 FR 70498, 12/6/04)
USCIS Proposed Rule to Lift Regulatory Response Times for RFEs and NOIDs
USCIS proposed rule will remove the fixed regulatory time limitations on responses to Requests for Evidence (RFEs) and Notices of Intent to Deny (NOIDs). Deadlines will be set on a case-by-case basis. The rule is designed to reduce case processing time. (69 FR 69549, 11/30/04)
USCIS Proposed Rule to Raise Fees for Appeals and Motions to Reopen or Reconsider
USCIS proposed rule will raise fees from $110 to $385, and will apply to fees for appeals and motions relating to the types of cases under the jurisdiction of the AAO. Comments are due on or before 12/30/04. (69 FR 69546, 11/30/04)
DHS Final Rule on US-Canada Agreement on Asylum Claims
DHS rule codifies the US-Canada agreement on which government decides certain asylum requests, sets USCIS asylum officers' authority in expedited removal, and codifies the definitions of "credible fear of persecution" and "credible fear of torture." (69 FR 69479, 11/29/04)
DOL Notice with Contact Information on New Processing Centers
