DOS Updates List of Countries Prohibiting Longshore Work by US Crews
The State Department has published a proposed rule updating the list of countries whose laws prohibit crewmembers on U.S. ships from performing longshore work. (67 FR 6447, 2/12/02)
DOJ Prohibiting Aviation Training of Certain Individuals Without Prior Notification
DOJ notice that the Aviation and Transportation Security Act (PL 107-71) bans flight training for aircraft above a certain weight for any alien unless the flight school notifies the Attorney General but temporarily grants advance consent for certain aliens. Effective 2/8/02. (67 FR 6051, 2/8/02)
Treasury Implements Law Concerning Firearms and Nonimmigrants
The Treasury Department has implemented PL 105-277 prohibiting the transfer to and possession of firearms and ammunition by nonimmigrant aliens in the U.S. In addition, nonimmigrants bringing such items into the U.S. for hunting or sporting purposes must obtain an import permit. INS Notice of Extension of TPS for Angola
INS announces the extension of the designation of Angola under the Temporary Protected Status (TPS) program. TPS for Angola will now expire on March 29, 2003. (67 FR 4997, 2/1/02)
INS Publishes T Visa Regulations
INS interim rule on the new T nonimmigrant classification, created by §107(e) of the Trafficking Victims Protection Act of 2000. The rule contains the essential elements that applicants must demonstrate, application procedures and evidentiary guidance. (67 FR 4783, 1/31/02)
INS Reopens Comment Period for 1998 Juvenile Processing Rule
INS has reopened the comment period to a July 24, 1998 proposed rule that would, among other things, establish procedures for processing juveniles in Service custody. Comments under the reopened period are due by March 15, 2002. (67 FR 1670, 1/14/02)
DOS Implements § 423 of USA Patriot Act
Pursuant to § 423 of the USA Patriot Act, the State Department amends 22 CFR § 42.21 to add to the definition of 'immediate relatives' the widows and children whose spouses/parents were the victims of the terrorist acts of 9/11/01. (67 FR 1414, 1/11/02)
DOS Updates Regulation on Issuance of Replacement Visas
The State Department is updating and clarifying its regulation at 22 CFR § 42.74, pertaining to the issuance of replacement visas, by deleting a citation which is no longer in force and making some additional editorial changes. (67 FR 1415, 1/11/02)
INS Final Rule on New Fees Starting 2/19/02
The fee adjustments proposed last August (66 FR 41456), have been implemented, without change, in an INS final rule. Applications or petitions "mailed, postmarked, or otherwise filed" on or after 2/19/02, require the new fee. (66 FR 65811, 12/21/01)
DOL Implements Web-Based LCA System
Recognizing operational problems with the LCA faxback system, DOL issues final rule establishing electronic filing of labor condition applications. Rule also creates new Form ETA 9035E, and facilitates frequent filings by same employer. (66 FR 63297, 12/5/01)
INS Notice of Effectiveness of New Form N-400
INS notice announces implementation of the new version of Form N-400. The new edition will be the only one useable for filing as of 1/1/02. (66 FR 57737, 11/16/01)
INS Obtains Approval of Practitioner Fraud Forms
INS notice of approval of new forms to implement a Practitioner Fraud Pilot Program. (66 FR 57486, 11/15/01)
INS Amends Custody Review Process
INS amends its rules on the review process with respect to long-term detention of persons subject to final orders of removal, deporation or exclusion, in light of the Supreme Court decision in Zadvydas v. Davis. (66 FR 56967, 11/14/01)
DOT Withdraws Rule on Drivers' Licenses
A Transportation Department proposed rule that would have implemented IIRAIRA provisions on state-issued drivers' licenses is withdrawn in light of the repeal of that legislative provision and the overwhelmingly negative comments. (66 FR 56261, 11/7/01)
DOJ Request for Comments on Detainees Communications with Attorneys Being Monitored
DOJ interim rule for comment on the change to allow monitoring of communications between detainees and their attorneys where a determination is made that it is necessary to deter violence or terrorism. Notice of the monitoring must be given. (66 FR 55062, 10/31/01)
EOIR Interim Rule on Change to Custody Orders
EOIR interim rule for comment amending regulations to expand the provision to provide for a 10-day automatic stay of release while INS seeks BIA review of an IJ's release from custody order where the INS ordered the person held without bond or set a bond of more than $10,000. DOS Amends List of Visa Classification Symbols
DOS amends its list of visa classifications to reflect INS' decision to have separate classifications for each of spouses, parents and children of U-1 and T-1 principals, and to add dependents of SN categories. (66 FR 53711, 10/24/01)
DOS Amends Q-2 Visa Regulations
DOS amends its rules on the Irish Peace Process Cultural and Training Program by adding requirements regarding the certification letter and moving a description of the factual elements that must be proven to a different regulation. (66 FR 52500, 10/16/01)
INS Implements Special Immigrant Category for Broadcasters
