DOS Proposes Changes in Access to Information Regulations
DOS proposed revisions to its regulations governing access by the public to information, to reflect changes made in the provisions of basic underlying laws and executive orders pertaining to access to information. Comments must be received on or before 6/29/04. (69 FR 16841, 3/31/04)
DOL Proposes Revisions to FOIA Regulations and Implementation of Electronic FOIA
The DOL proposes updating of its Freedom of Information Act (FOIA) procedures to streamline existing procedures, reflect certain changes in FOIA procedural requirements since current regulations were issued, and to clarify DOL procedures. Comments must be received by 5/14/04. (69 FR 16739, 3/30/04)
EOIR Rule Would Specify IJ Authority Under the U.S./Canada Safe Third Country Agreement
EOIR proposed rule specifying the authority of immigration judges with respect to issues arising under the U.S./Canada “Safe Third Country” agreement including asylum claims made by individuals arriving from Canada at land border ports of entry. Comments are due by 5/7/04. (69 FR 10627, 3/8/04)
DOS Amends U.S. Passport Regulations
DOS interim final rule clarifies that revoked, lost, or stolen passports are invalid. The interim final rule requires specified photographs and personal appearance of all applicants not eligible to apply by mail. Comments must be received no later than 4/26/04. (69 FR 15669, 3/26/04)
President Amends Executive Order Implementing Trafficking Act
President Bush amends a prior Executive Order implementing the Trafficking Victims Protection Reauthorization Act of 2003 by addressing the Senior Policy Operating Group's and the Secretary of State's authorities and responsibilities. (69 FR 13455, 3/23/04)
OSC Funding for Combating Immigration-Related Unfair Employment Discrimination
OSC announces the availability of funds for grants to conduct public education programs about the rights of potential victims of employment discrimination and the responsibilities of employers under the INA’s anti-discrimination provisions. Applications due 5/7/04. (69 FR 13584, 3/23/04)
ORR Publishes Notice of Available Funds for Services to Torture Victims
The Office of Refugee Resettlement (ORR) of the Department of Health and Human Services (HHS) provides notice of a funding opportunity for services to torture victims. The ORR expects to award 25 - 30 grants. Applications are due by 5/21/04. (69 FR 13307, 3/22/04)
DOS Redesignates and Designates Terrorist Organizations
The DOS redesignates Al-Aqsa Martyrs Brigade, Asbat al-Ansar, and Salafist Group for Call and Combat, and designates Ansar al-Islam, as terrorist organizations, effective 3/22/04. (69 FR 13347, 3/22/04)
ORR Announces Proposed Allocations to States of FY2004 Refugee Social Service Funds
HHS’s Office of Refugee Resettlement notice setting forth the proposed allocations to states of FY2004 funds for refugee social services under the Refugee Resettlement Program. ORR has available $152,217,586 in FY2004 refugee social service funds. (69 FR 13056, 3/19/04)
DOS Interim Final Rule Eliminates Crew List Visas
DOS interim final rule finalizes on an interim basis the agency’s 12/13/02 proposed rule to eliminate crew list visas. The rule’s preamble notes that the DOS is eliminating the crew list visa for security reasons. The rule takes effect on 6/16/04, with comments due by 5/17/04. (69 FR 12797, 3/18/04)
USCIS Procedures for H-2B Petitions in Wake of Cap Cut-Off
USCIS notice that it is no longer accepting H-2B petitions for FY2004 now that the cap has been reached and will adjudicate all those received on or before 3/9/04. H-2B petitions filed for employment to begin on or after 10/1/04 to be counted against the FY2005 cap. (69 FR 12340, 3/16/04)
DHS Eliminates Numerical Cap on Mexican TNs
DHS interim rule removes the annual numerical cap on the number of Mexican professional admissions under NAFTA. The rule also eliminates the associated requirement of a petition for a Mexican-based NAFTA professional and the corresponding LCA. (69 FR 11287, 3/10/04)
DHS Proposes Rule Implementing ‘Safe Third Country’ Agreement
DHS proposed rule that would implement the U.S./Canada “Safe Third Country” agreement which, among other things, provides for a threshold determination to be made as to which country will consider the merits of a prospective asylee’s claims. (69 FR 10620, 3/8/04)
DOS Removes Restriction on Use of U.S. Passports for Travel to Libya

DOL Announces H-2A Adverse Effect Wage Rates for 2004
DOL announced 2004 adverse effect wage rates (AEWRs) for employers seeking H-2A workers for temporary/seasonal agricultural labor/services. Employers must pay the highest of the AEWR, the applicable prevailing hourly wage rate, or the legal federal or state minimum wage rate. (69 FR 10063, 3/08/04)
President Authorizes $20 Million for Refugee Assistance in the West Bank and Gaza
The President has determined that up to $20 million should be made available from the U.S. Emergency Refugee and Migration Assistance Fund to address unexpected, urgent refugee needs in the West Bank and Gaza. (69 FR 9917, 3/3/04)
DHS on H-1B Processing Now that the Cap is Reached
USCIS notice stating that H-1B petitions filed after 2/17/04 will be returned, pending petitions will be adjudicated in the order they were received and premium processing will not be suspended. Information on restoration of numbers, withdrawal procedures and appeals included. (69 FR 8675, 2/25/04)
HHS Updates Poverty Guidelines for 2004
HHS updated the poverty guidelines for 2004, accounting for last year's increase in prices as measured by the Consumer Price Index. This data is used in determining ability to provide support in connection with the affidavit of support. (69 FR 7335, 2/13/04)
USCIS Publishes Proposed Fee Schedule Increases
This rule proposes to increase application fees by approximately $55 per application, and increase the biometric fee to $70. Written comments are due on or before 3/4/04. (69 FR 5088, 2/3/04)
DOS Publishes Notice of Actions by the Colombian Armed Forces Regarding Respect for Human Rights
The DOS reports that the Colombian Armed Forces is suspending and prosecuting human rights violators within its ranks, and taking other actions to disassociate from human rights violations. (69 FR 4555, 1/30/04)
USCIS Announces Direct Filing for Special Immigrant Classification
