DOS Final Rule on Issuance of Replacement Visas
The State Department has finalized an interim rule that updated and clarified its regulation at 22 CFR § 42.74, pertaining to the issuance of replacement visas, by deleting a citation which is no longer in force and making some additional editorial changes. (68 FR 13627, 3/20/03)
DOS Final Rule Waiving Visa Fees for B-1 U.N. Observers
The State Department has finalized without change an interim rule that expanded the waiver of the visa application and issuance fees for diplomats to include B-1 visas for members of observer missions to the United Nations. (68 FR 13727, 3/20/03)
DOS Final Rule Expanding Definition of Immediate Relative to Include 9/11 Widows, Children
The State Department has finalized without change an interim rule implementing § 423 of the USA PATRIOT Act to expand the definition of immediate relatives to include the widows and children whose spouses/parents were the victims of the terrorist acts of 9/11/01. (68 FR 13728, 3/20/03)
INS Updates on the Visa Waiver Program
INS interim rule terminating Uruguay’s participation in the VWP effective 4/15/03. All Belgian nationals seeking admission under the VWP after 5/15/03 must present a machine-readable passport. Italy and Portugal to continue participanting. (68 FR 10954, 3/7/03)
INS Final Rule Transfering Authority from INS and DOJ to DHS
DHS final rule amending 8 CFR providing for the transfer of authority to administer and enforce the immigration laws to the Secretary of Homeland Security, and for the redelegation of that authority by same. (68 FR 10922, 3/6/03)
DOJ Continues Reorganization of 8 CFR, Conforming Internal Citations
DOJ has issued a final rule effecting technical amendments to internal citations in new 8 CFR Chapter V (8 CFR was reorganized in a 2/28/03 rule to reflect the transfer of INS to Department of Homeland Security and the retention of EOIR within DOJ). (68 FR 10349, 3/5/03)
OSC Announces Availability of Public Education Grants
The Office of Special Counsel for Immigration Related Unfair Employment Practices (OSC) announced the availability of grant funds to conduct public education programs about immigration related employment discrimination. (68 FR 10487, 3/5/03)
INS Interim Rule Extends Automated Inspection Services Enrollment Period
INS interim rule extending from one year to two years the enrollment period for the Automated Inspection Services (AIS) programs, such as INSPASS and SENTRI. The rule took effect retroactive to 2/28/03 and comments are due 4/29/03. (68 FR 10143, 3/4/03)
DOJ Comment Request Extension for NSEERS Program
DOJ extension for 30 days of the information collection request to OMB for review of the National Security Entry-Exit Registration System. Comments will be accepted until 4/2/03. (68 FR 10034, 3/3/03)
DOJ Reorganizes 8 CFR, Reflecting Reorganization of INS into DHS
Final DOJ rule reflecting transfer of INS to Department of Homeland Security (and retention of EOIR within DOJ), including creation of new 8 CFR Chapter V. (68 FR 9824, 2/28/03)
INS Notice that Filing Fees Returned to Pre-1/24/03 Levels
INS interim rule readjusting the agency's fee schedule to restore surcharges used for asylum and refugee services, fee exemptions and fee waivers. The surcharges were deleted in a 1/24/03 rule, by a now repealed provision of the Homeland Security Act. (68 Fr 8989, 2/27/03)
Rule Authorizes AG to Waive Immigration Training for Local, State Law Enforcement Officers

DOL Announces H-2A Adverse Effect Wage Rates for 2003
DOL announced state-by-state 2003 adverse effect wage rates (AEWRs) for employers seeking H-2A workers for temporary or seasonal agricultural labor or services. Employers must pay the highest of the AEWR, prevailing hourly wage rate, or legal federal or state minimum wage rate. (68 FR 8929, 2/26/03)
INS Designates Additional Ports for Special Registrant Departures
INS notice and correction expanding the list of ports through which nonimmigrants subject to Special Registration can depart the U.S. As of 3/3/03, there will be 99 ports authorized for such departures, up from the current 68. (68 FR 8967, 2/26/03) (68 FR 8047, 2/19/03)
Special Registration Groups 3 and 4 Deadlines Extended
INS notice that persons subject to the 2/21/03 and 3/28/03 deadlines for call-in NSEERS special registration (Groups 3 and 4, respectively) will have an additional four-week period, until 3/21/03 (for Group 3) and 4/25/03 (for Group 4), in which to register. (68 FR 8046, 2/19/03)
DOJ Implements Flight Training Candidate Checks Program
Final rule, effective 3/17/03, implementing provisions of Aviation and Transportation Security Act, which imposes notification and reporting requirements on certain persons who provide aviation training to undocumented individuals and other specified individuals. (68 FR 7313, 2/13/03)
HHS Updates 2003 Poverty Guidelines
HHS has updated its poverty guidelines to account for last year's increase in prices as measured by the Consumer Price Index. This data is used in determining ability to provide support in connection with the affidavit of support. (68 FR 6456, 2/7/03)
DOS Interim Rule on Visa and Passport Waiver Revocation
DOS interim rules to eliminate the current passport and visa waiver for residents of Canada or Bermuda who have a common nationality with citizens of Canada or with British subjects in Bermuda. The rules takes effect on 3/17/03 and comments are due by 4/1/03. (68 FR 5194, 1/31/03)

DOS Designates Additional Group as Foreign Terrorist Organization
On 1/30/03, the Secretary of State, in consultation with the Attorney General and the Secretary of the Treasury, designated the Pakistani group known as Lashkar I Jhangvi as a foreign terrorist organization pursuant to INA § 219(a). (68 FR 4811, 1/30/03)

INS notice implementing the class action judgment in Proyecto San Pablo v. INS by notifying aliens who applied for legalization under INA § 245A of their rights under the judgment. (68 FR 4518, 1/29/03)
INS Final Rule Barring Release of Detainee Information
INS has adopted as final, without change, an interim rule barring the public release of information on INS detainees by any non-federal provider of detention services, and clarifying that all such requests for information be directed to the INS. (68 FR 4364, 1/29/02)
DHS Interim Rule on Obtaining Information Under FOIA and the Privacy Act
