DOL Publishes General Wage Determination Decisions For Federal and Federally-Assisted Construction

DOS Rule Codifies Post-9/11 Policy Change on Waiver of Nonimmigrant Visa Applicant Interviews
DOS interim rule codifies the Department’s post-9/11 change of policy on visa interviews, which has increasingly restricted the number of instances in which the interview of a nonimmigrant visa applicant may be waived. (68 FR 40127, 7/7/03)
Treasury Department Seeks Comments to Final Regulations on Foreign Government-Issued Identification
The Treasury Department reopened its decision to accept foreign government-issued ID documents at financial institutions, asking whether some situations should preclude reliance on certain foreign documentation to verify customer identity. Comments are due by 7/31/03. (68 FR 39039, 7/1/03)
BCIS Notice of Extension of TPS for Montserrat

DOS Adds T Visa Category for Certain Victims of Severe Human Trafficking
Interim rule from DOS, effective 8/25/03, adds new T visa category, which provides nonimmigrant status to certain victims of severe forms of human trafficking under the Trafficking Victims Protection Act of 2000 (68 FR 37963, 6/26/03)
DOL Availability of $50 Million in H-1B Technical Skills Training Grants
DOL solicited requests and provided guidance for the business-led technical skills training grant funds available under ACWIA. The training program is intended to address domestic shortages in high skill and high technology occupations and to reduce dependence on H-1B workers. (68 FR 37553, 6/24/03)
BCIS Publishes Revised FOIA Request Form for Use in Proyecto San Pablo v. INS Cases
BCIS revised the FOIA form, effective 6/24/03, for foreign nationals requesting documentation and information to support claims for new decisions on their legalization applications under the Proyecto San Pablo v. INS judgment. (68 FR 37508, 6/24/03)
DHS Notice Conforming Title 8 of the CFR to New DHS

DHS Revises Parole Authority Regulation

DOS Regulation Regarding INTELSAT "International Organization" Status
DOS final rule adding INTELSAT (following privatization) to the list of "international organizations" for purposes of the Immigration and Nationality Act. The rule also clarifies the status of the organization and the personnel affected. (68 FR 32359, 5/30/03)
DOL Guidance Regarding Limited English Proficiency
DOL published policy guidance to Federal Financial Assistance Recipients, including State Workforce Agencies, regarding Title VI’s prohibition against national origin discrimination as it affects limited English proficient people. Comments are due by 6/30/03. (68 FR 32289, 5/29/03)
DOS Amends SEVIS Regulations
The DOS is adding the requirement that consular officers verify SEVIS-generated I-20s and DS-2019s in the Consolidated Consular Database, and verify the payment of applicable SEVIS fees. The new rule also makes Border Commuter Students subject to SEVIS requirements. (68 FR 28129, 5/23/03)
DOS Interim Rule Implements PATRIOT Act’s Special Immigrant Provisions
A DOS interim rule implements § 421 of the USA PATRIOT Act by creating a new visa classification ‘SP’ for certain victims of the 9/11 terrorist attacks and setting forth the eligibility requirements for the issuance of an immigrant visa in that category. (68 FR 24638, 5/8/03)

President Authorizes Use of $22 Million for Refugee Assistance in the Middle East

Amended Executive Order Addressing Classified National Security Information

DOJ Exempts FBI’s National Crime Database from Privacy Act’s Accuracy Requirements
DOJ final rule exempts FBI’s National Crime Information Center database from the Privacy Act, thus FBI need no longer ensure the accuracy and timeliness of incriminating information about a particular individual. (68 FR 14140, 3/24/03)
